Japan high court rules same-sex marriage ban unconstitutional

The Fukuoka High Court on Friday became the third high court in Japan to rule the country’s lack of legal recognition of same-sex marriage is unconstitutional, but upheld a lower court ruling to dismiss plaintiffs’ claim for damages. In the ruling, the court judged for the first time that civil law provisions not allowing same-sex marriage violated Article 13 of the Constitution, which guarantees the right to the pursuit of happiness. The court also said the ban violates sections of the Constitution that guarantee equality under the law and upholds individual dignity and the essential equality of both sexes. “There is no longer any reason to not legally recognize marriage between same-sex couples,” Presiding Judge Takeshi Okada said.

(Update) Disabled man denied entry to matchmaking party in Tokyo

A man who has experienced nightmare dates with women he met online believed that a Tokyo government-related matchmaking service would provide a safe and perhaps last opportunity to find love.
But the not-for-profit organization that arranged the matchmaking event rejected the man’s application to attend after learning about his minor intellectual disability. The organizer said in a notice that participants are “limited to mentally and physically healthy people.” The Bureau of Citizens, Culture and Sport found fault with the way the organization treated the man after learning about his disability, and it temporarily suspended the organization’s event announcements on the website.

As with other matching tools, users of the “Irodori” app register their own information, such as date of birth and gender, and it has a field to enter whether or not they have a disability. The app has communities where people with similar interests can communicate with each other, and a matching function for men and women. Users’ feedback included, “I have been able to casually talk with people who have similar characteristics to myself.”
