Former Eugenic Protection Law plaintiff, man from Sendai City visits his father’s grave to announce victory in lawsuit

Following the Supreme Court’s ruling ordering the government to pay compensation for the former Eugenic Protection Law, a plaintiff living in Tokyo visited his father’s grave in his hometown of Sendai to report the outcome of the trial. As a child, Kita was placed in an institution for behaving in a problematic manner, and was forced to undergo surgery at the age of 14.

Prime Minister Fumio Kishida instructed Ayuko Kato, minister in charge of child policy, to set up a meeting between him and the plaintiffs this month, Kato told reporters after she met with Kishida at the prime minister’s office. Kato met with the plaintiffs on Thursday.

The documentary film ‘Mark – A Call to Action’ about the late Dr. Mark Bookman, Tokyo based disability studies scholar and advocate will be released on DVD in October 2024.

Japan’s Supreme Court on Wednesday awarded damages to victims of forced sterilizations conducted under the now-defunct eugenic protection law. 

Handing down a unified ruling on five related damages suits, the top court’s Grand Bench, presided over by Chief Justice Saburo Tokura, decided not to apply the 20-year statute of limitations for damages claims, a focal point of the case. It effectively handed total victory to the plaintiffs.

Japan’s Supreme Court on Wednesday awarded damages to victims of forced sterilizations under the now-defunct eugenic protection law. 
   The top court’s Grand Bench, presided over by Chief Justice Saburo Tokura, decided not to apply the 20-year statute of limitation for damages claims, a focal point of the case, effectively handing victory to the plaintiffs.

Maebashi Court Orders Man to Pay 960,000 Yen in Damages Over Disability Hate Speech on Online Anonymous Bulletin Board Despite Defamation Claim Rejected

Maebashi District Court has ordered a man who made a post on an anonymous bulletin board on the Internet to pay 960,000 yen in damages.

Kazuaki Hyodo (48), a man with severe disabilities from Maebashi City, was seeking approximately 1.95 million yen in damages from the man who made the post, in Tokyo, for suffering mental pain after being defamed on an anonymous bulletin board on the Internet. On December 8th, the Maebashi District Court (presiding judge Ritsuko Jinno) handed down a judgment ordering the man [who posted] to pay approximately 960,000 yen.

Japan’s Supreme Court Grand Bench to Rule on Forced Sterilization Damages

The Japanese Supreme Court’s First Petty Bench decided Wednesday to have the top court’s Grand Bench issue a unified ruling on five damages lawsuits filed by forced sterilization victims under the now-defunct eugenic protection law. 

The Grand Bench, presided over by Chief Justice Saburo Tokura, is expected to hand down such a ruling next year on the suits, with the top court’s judgment on whether the 20-year statute of limitation for damages claims applies in the cases a focal point.
