FUKUOKA – On December 24th, a hearing impaired couple from Fukuoka Prefecture filed a lawsuit at Fukuoka District Court on the grounds that they were forced to undergo infertility surgery under the old Eugenic Protection Act, an act which violated basic human rights guaranteed by the Constitution. They are seeking damages of 10 million yen.
The couple, a 82-year-old man and his 78-year-old wife, had been considering filing a lawsuit since April 2018.
According to complaint, in the late 1960s, her husband was operated without consent under the old Eugenic Protection Law. They claim that it violates the constitution’s right to dignity and the pursuit of happiness.” Such a state has been branded as ‘an inferior life that should not have been born.’
His wife, appealed through sign language, saying, “I sometimes wanted a child. I’m full of frustration.”
